| Article 1. GENERAL PROVISIONS |
These terms of sale apply only to the current rate published by " LA MAISON DU STEVIA " Ltd
(Limited Liability Company) this later called La Maison du Stevia. They cancel those of the previous publications and
can be modified at any time.
Any order implies the complete support without reserve of the customer on the present general conditions.
Quite other condition established by the buyer is thus by default inopposable to the salesman.
If the salesman, at some point, violates one of the quoted conditions, it cannot be interpreted as a renunciation of the salesman of the
general conditions of sales.
La Maison du Stevia reminds that, according to the decision of the European Commission of February 22nd, 2000, the stevia is not
considered as a food within the European Union.
In the respect for this principle of precaution, seeds and plants sold by our establishment to the private individuals have no vocation
to be consumed. Our House supplies plantations of stevia only in decorative purposes.
La Maison du Stevia is the owner of the Web site http: // www.lamaisondustevia.com and is holder of all the rights. Except preliminary
and express license of La Maison du Stevia, it is forbidden to copy or to download everything or part of the site or its contents. |
| Article 2. ON-LINE ORDER |
To order wished articles, enter in their sheet by clicking their photo or their reference, click "Add to cart".
Your choice will automatically be added to your shopping basket.
You can choose several products of the same reference by changing the quantities in the shopping basket.
When you will have ordered all the wished products, click "Buy now" then fill forms with your complete coordinates and method of payment.
In case of neglect, your order will not be valid.
You also have the possibility of cancelling one of the products beforehand selected by registering "0" in the column of the quantities
or by marking the compartment "Delete" then by clicking "Calculate" so that your basket updates.
At the end of the form, do not forget to click "Confirm order", without what your order will not be confirmed.

| Article 3. PRICE |
Unless otherwise specified, the prices of our products get TTC. They are indicated in euro.
Products are subjected to the French VAT. Plants are taxed at the level of 5,5 %, the other products in 19,6 %.
Any order is charged to the conditions appearing on the catalog current in the date of recording of the order. But the prices can be afterward
modified, without advance notice.
Products remain the property of La Maison du Stevia up to the complete payment of the price.
CARRIAGE EXPENSE PARTICIPATION
All our plants are delivered by Colissimo in working 48 hours in France and 4 to 8 days in European countries. Postal charges are automatically
calculated according to the weight of your goods and of your address of delivery as you click the button "Order" of the shopping baskets.
The deliveries can be made in all the EC and DOM-TOM.
The possible customs duties would be to settle by the buyer. |
| Article 4. PAYMENT |
You will be invited to pay on-line your order by Credit card, Visa, Eurocard, Mastercard. To be registered, the order must
be paid in its completeness. The unpaid orders are not delivered. Any outstanding payment or incident of payment (coordinated banking false,
defect of reserve of the account of the customer) will be charged 14,35 euros TTC.
An invoice resuming the various elements of the order will be sent with the parcel or by mail - if the address of delivery is
different from the address of invoicing. |
| Article 5. SECURITY |
The protocol of security used ( SSL) guarantees a total confidentiality of the personal information passed on
on Internet.
La Maison du Stevia undertakes to pass on the personal information of its customers only to its bank with the aim of the payment
of the order.
All other left information about the site (name, e-mail) will be the object of no other exploitation (rent or sale of file) that the strict
activity of La Maison du Stevia. (Law " Data processing and Liberties " N 78-17). |
| Article 6. ORDER ACCEPTANCE |
| All our offers get within the limits of available stocks. For products not stored in our stores, our offers are valid subject to availability at our suppliers.
According to the terms of the article L.111-1 of the Code of the consumption, the customer is capable, before the conclusion of the contract, of knowing the essential characteristics of the good or the service, namely its nature, its quantity and its substantial qualities..
Before the conclusion of the telematic sale contract, the customer will see on his screen an order form (tab "Confirmation" of the process of validation of order) representing in detail its whole order valued at the price inclusive of all taxes which he can modify or cancel on the way back in his shopping basket. The validation of this order form will be worth conclusion of the telematic sale contract.
The fact for a user to fill the order form appearing on the site http: // www.lamaisondustevia.com and to confirm the order (by clicking the button "Confirm order" foreseen for that purpose) is worth full and whole acceptance of the present conditions, which will be only applicable to the contract so concluded and the acceptance of the payment by the debit of its credit card at the indicated price.
The sale becomes definitive after acceptance of the deal of the secure services of the on-line payments.
The data registered by lamaisondustevia.com constitute the proof of all the deals spent by lamaisondustevia.com and its customers.
The data registered by the system of payment constitute the proof of the financial transactions.
La Maison du Stevia saves itself the possibility of not to book order whatever reason it is, liking in particular a problem of supply of products, a problem concerning the successful order or the predictable problem concerning the delivery to be made. If the user wishes to cancel his order, the cancellation has to intervene by email sent to La Maison du Stevia at the latest 12 hours after validation of the order by the customer.
The possible delays do not give right to the buyer to cancel the sale, to refuse the goods or to claim damages. Any complaint for nonconformity or absent person in the delivery of the product must be passed on within 48 hours as from the reception of the product in its original packing. |
| Article 7. PERIOD OF RETRACTION |
The right of retraction does not apply for the contracts of supply of perishable products (the plantations of stevia
enter this category), the audio or video recordings or of computer software unsealed by the consumer, the periodic newspapers and the magazines
and the services the execution of which began before the end of the period of 7 days.
For other products or services, and according to the provisions of the article L. 121-16 of the French Code of the consumption, the customer has,
as from the delivery, a period of 7 workdays to return the order for the purposes of exchange or of refund.
The exercise of the right of shrinkage obliges the storekeeper to refund the sums paid by the buyer within 30 days.
The consumer has to take at his expense the expenses of dismissal of the goods. The product will necessarily have to have returned to its original
packing, intact, accompanied with all the possible accessories, the notes of use and documentations. |
| Article 8. DELIVERY |
From reception of your order (handwritten or electronic), you will receive your parcel as soon as possible.
La Maison du Stevia guarantees that products were the object of all the necessary care to insure their correspondence to the description
which appears on the site in the date of the order. The address of delivery does not have to be a POB. If such was the case, the order could not
be considered.
To serve you better, La Maison du Stevia has selected Colissimo and The Post office for the transport of your parcel.
Products are sent to the address of delivery indicated in the order. In case of absence of the addressee or of a person which could take
up products during the delivery, the carrier will deposit a calling card at the address of delivery indicated by the customer inviting him
to remove products. On no account, La Maison du Stevia would know how to be responsible for a possible deterioration of products
because of their late collect at the carrier. |
| Article 9. COMPLAINTS |
The possible delays do not give right to the buyer to cancel the sale, to refuse the goods or to demand damages.
In case of complaint, the transport costs and the other expenses (customs) for the return of products at La Maison du Stevia are chargeable
to the buyer. The refund of products is only due provided that is noticed no abnormality on products. If such was the case, La Maison du
Stevia reserves the right not to pay off the customer.
The customer can emit reserves during the delivery of the products only in case of not corresponding delivery quantitatively with order, or
in case the package containing products would be strongly damaged. These reserves must be made in writing with the carrier during the delivery,
or at the latest 4 hours after this delivery. A copy of these reserves must be sent at La Maison du Stevia (by e-mail) at the latest 12
hours after these reserves are made.
No return of products will be accepted and we do not proceed to exchange. If the procedure above was respected, and if it is proved that
the package and the products are strongly damaged, La Maison du Stevia in its choice will establish credit note, will pay off to the
customer the paid price or will make a new delivery of similar products. |
| Article 10. RESPONSIBILITY |
The customer is only responsible for the choice of products, for their conservation as from the delivery and
from their use. On no account La Maison du Stevia could be considered responsible for any damage occurring of this fact.
La Maison du Stevia guarantees that products belong in perfect state during the delivery to the carrier. This is the only guarantee
granted by La Maison du Stevia. No other express or tacit guarantee is granted. In particular, La Maison du Stevia cannot guarantee
that products will answer to specific expectations of the customer.
La Maison du Stevia cannot be considered as responsible for the non-fulfillment of the contract concluded in case of shortage of stock or
unavailability of the product, the force majeure, the disturbance or the all-out or partial strike, notably, postal services and means of
transportation, flood or fire.
Photos and reproduced texts and illustrating the presented products are not contractual. As a consequence, the responsibility of La Maison
du Stevia cannot be engaged in case of error in one of these photos or one of these texts.
La Maison du Stevia will incur no responsibility for any consequential damage because of the present (operating loss, loss of profit,
loss of chance, damages or expenses).
La Maison du Stevia can be on no account considered responsible for any damage whatever nature it is resultant of any impossibility of
use, access, any loss or loss of earnings ensuing from information available on this server, and this whatever is the origin of the damage.
La Maison du Stevia also declines any responsibility for any damage of some nature that it is resultant of an intervention deceitful of
a third party having pulled a modification of the put at the disposal information about its site.
It cannot be considered responsible for any damage, whatever nature he is, resulting from the interpretation or from the use of the information
available on this server.
In any case, whatever is the possible motive of the questioning of La Maison du Stevia, its responsibility is limited to the weakest
of following both sums: i) taking up of the direct damage undergone by the customer or ii) prices of the order. |
| Article 11. RISK |
The transfer of the risks on products takes place from the delivery of products by La Maison du Stevia
for the carrier. So, products travel at the risks and the dangers of the customer.
If, for a reason independent from our will, we came to miss a product, we would replace it by another equivalent in quality and price,
to avoid a delay in delivery (except express indication of the customer). |
| Article 12. INDIVIDUALS INFORMATION |
La Maison du Stevia undertakes in not to reveal to third parties the information which are communicated
with it. These are confidential. They will be used by its internal services only for the treatment of the orders and to strengthen and
personalize the communication and the cultural offer and the products reserved for the customers of La Maison du Stevia. The present
article cannot prevent the transfer nor the transfer of activities to a third party.
According to the French law « computer and liberties » of January 6th, 1978, every customer has a right of access, rectification, and opposition
for the specific data concerning him. To benefit from this access you just have to make the on-line demand or by mail indicating his name,
first name, address and so possible reference customer:

contents, the advertisements, the products, the services or quite other available material on either from these sites or external sources.
Furthermore, every user recognizes that La Maison du Stevia cannot be considered responsible for any damages or losses turned out or
adduced consecutive either in connection with the use or with the fact of having relied on the contents, on the possessions or the services
available on these sites or external sources. |
| Article 14. APPLICABLE LAW |
Only the present conditions in French language are valid. The rights and the obligations of the parties
are governed by the French law, more particularly in the rule of the sale at distance (articles L. 121-16 in L. 121-20 of the French
Code of the consumption integrating the directive 97/7 IT of May 20th, 1997 relative to the protection of the consumers in contracts at distance).
The acceptances, the drafts, the mandates, conditions of carriage do not bring either novation or infringement to this clause.
For any disputes and contestings, whatever is the nature or the cause, only will be competent the French courts. |
